NEXSEE DIGITAL — TERMS OF SERVICE
Last Updated: May 2026 These Terms of Service govern your use of the NexSee Digital website (NexSeeDigital.com) and services. By submitting a request or engaging with our services, you agree to these terms.
1. ABOUT NEXSEE DIGITAL
NexSee Digital ("NexSee Digital") is a custom MT4 and MT5 Expert Advisor development service. We develop custom trading Expert Advisors and automation systems based on client requirements. We do not provide financial advice, investment advice, or trading recommendations. We build automation tools.
2. SERVICES PROVIDED
NexSee Digital provides the following services: - Custom MT4 Expert Advisor development - Custom MT5 Expert Advisor development - Custom algorithmic trading systems - Risk management tools - Copy trading system setup (monthly service) - VPS setup for EA hosting - EA updates, fixes, and improvements All services are provided based on the client's stated requirements, agreed specification, and chosen package.
3. THE DEVELOPMENT PROCESS
NexSee Digital follows a structured development process: Step 1. Client submits an EA request form Step 2. NexSee Digital reviews the request Step 3. If unclear, NexSee Digital contacts the client with clarification questions Step 4. NexSee Digital creates an EA Development Specification Step 5. Client reviews and approves the specification Step 6. Client pays the minimum 40% deposit Step 7. Development begins based on the approved specification Development does not begin immediately after a form submission. Development only starts after the client has reviewed and approved the final EA Development Specification and the minimum 40% deposit has been paid. The approved specification is the agreed scope of work. Features not included in the approved specification are not part of the delivery.
4. CHANGES AFTER APPROVAL
If the client requests changes after approving the EA specification, those changes may require additional time and additional cost depending on the scope of the changes. Minor clarifications that do not change the agreed logic may be accommodated. Significant changes to the strategy, risk rules, or features are treated as a new or updated scope.
5. DELIVERY AND TESTING
Delivery timelines depend on EA complexity, requested features, review time, and the approved specification. Final timelines are confirmed after review and approved specification. Delivery times are estimates only and are not guaranteed. The client is responsible for testing the delivered EA thoroughly before using it on a live trading account. NexSee Digital strongly recommends testing on a demo account first. NexSee Digital is not responsible for trading losses, drawdowns, or negative results arising from the use of a delivered EA on any account, demo or live.
6. REVISION POLICY
One post-delivery revision is included for small adjustments related to the approved EA specification. Additional revisions, new features, or changes outside the approved specification may require extra cost and additional development time.
7. SUPPORT
After delivery, clients receive priority support during the initial handover period. After that, support requests are handled through the normal support queue based on urgency, project type, and request complexity.
8. NO FINANCIAL ADVICE
NexSee Digital does not provide financial advice, investment advice, or trading recommendations of any kind. The trading strategies, entry and exit rules, risk settings, and all other EA logic are defined by the client. NexSee Digital implements the client's stated requirements. The client is responsible for the trading logic they request.
9. NO PROFIT GUARANTEE
NexSee Digital does not guarantee any trading results, profits, win rates, or account performance from any EA or system we develop. Trading financial instruments including forex, gold, indices, and other markets involves significant risk. Past performance does not guarantee future results. You can lose more than you invest. Any EA developed by NexSee Digital should be treated as a tool that automates a trading strategy. The performance of that strategy depends on market conditions, broker conditions, and many factors outside NexSee Digital's control.
10. THIRD-PARTY SERVICES
Certain services involve third-party platforms and providers that are entirely outside NexSee Digital's control. These include: - MetaTrader 4 and MetaTrader 5 platforms - Your broker or trading account provider - VPS providers (when VPS setup is requested) - Copy trading platforms - Payment processors (when applicable) NexSee Digital is not responsible for the availability, reliability, policies, or actions of any third-party service. Any issues with a broker, MetaTrader platform, or VPS provider must be resolved directly with that provider.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, NexSee Digital's total liability for any claim arising from our services is limited to the amount paid by the client for the specific service in question. NexSee Digital is not liable for: - Trading losses of any kind - Indirect, consequential, or incidental damages - Losses arising from EA use on live accounts before testing - Platform outages, broker issues, or market conditions - Losses from changes in market behaviour after delivery
12. SOURCE CODE
NexSee Digital delivers the working EA file for client use. Source code is not included by default and remains the property of NexSee Digital unless a separate written agreement is made before development begins. This helps protect the development structure, maintain version control, and provide future updates through a controlled process.
13. FUTURE FEATURES
NexSee Digital may introduce a client portal, admin panel, payment system, or other features at a later stage. These features are not currently active. Any such additions will be governed by updated terms published on this website.
14. GOVERNING LAW
These Terms of Service are governed by applicable law. Any disputes will be handled in good faith between NexSee Digital and the client. If a dispute cannot be resolved directly, it will be subject to the jurisdiction of the courts applicable to NexSee Digital's place of operation.
15. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time. The updated version will be published on this page with a revised date. Continued use of our services after changes means you accept the updated terms.
